Chapter 2. EMPLOYMENT VISA FOR FOREIGNERS AND IMMIGRATION CONTROL

Examples of Specific Activity (E-7) Visas by Occupation

■ Tourist Interpreter Guide
This refers to individuals who provide convenience to foreign tourists traveling domestically by using foreign languages ​​to explain tourist attractions and objects or to guide their travels. Qualification requirements include holders of a master's degree or higher obtained overseas, individuals with a bachelor's degree or higher related to "Korean Studies" obtained from foreign universities and with one or more years of experience, graduates of domestic universities majoring in tourism or history, and those who have obtained a domestic tourism interpreter guide certificate from a recommendation issued by the Minister of Culture, Sports, and Tourism (Tourism Industry Division). For employment, the company must meet the standard of being a general travel agency that has completed tourism business registration and has attracted an average of 2,000 or more foreign tourists annually over the past two years, or have equivalent performance. If the employment company meets the standards, a maximum of two people can be allowed per company, and if the number of foreign tourists attracted is more than 5,000, additional employment is allowed at a rate of one person per 2,000 foreign tourists.

■ Travel Package Developer
This refers to individuals who plan and develop travel packages that meet the needs of customers and communicate with domestic and foreign travel agencies to organize group tours for customers. They also obtain information on various available means of transportation, including costs and convenience, and provide advice on travel plans. Qualification requirements include holders of a master's degree obtained overseas, individuals with a bachelor's degree or higher and one or more years of experience obtained overseas, and those with a bachelor's degree or higher from domestic universities. They must obtain a recommendation issued by the Minister of Culture, Sports, and Tourism (Tourism Industry Division) for employment. The employment company must meet the standard of a general travel agency that has completed tourism business registration in accordance with Article 4 of the Tourism Promotion Act and has attracted an average of 2,000 or more foreign tourists annually over the past two years (submitting a certificate of foreign tourist attraction issued by the Korea Association of Travel Agents) or has equivalent performance. For the protection of national employment, a maximum of two people are allowed per company.

■ Hotel Receptionist
This refers to the front desk personnel who handle customer check-ins and reservations, confirm bookings upon customer arrival, take appropriate action when necessary, and perform various customer service duties in hotels. Qualifications include possession of an overseas master's degree, possession of an overseas bachelor's degree with at least one year of experience, or possession of a domestic bachelor's degree or higher. These individuals must also obtain an employment recommendation certificate issued by the Minister of Culture, Sports, and Tourism (Tourism Industry). According to the provisions of Article 2 of the Enforcement Decree of the Tourism Promotion Act, hotels with a foreigner occupancy rate exceeding 40% in the previous year among tourism hotels, floating tourism hotels, traditional Korean hotels, and family hotels are allowed to employ up to two people per company to protect domestic employment.

■ Interpreter/Translator
This refers to individuals who specialize in the professional task of translating one language to another or facilitating smooth communication between people who speak different languages by converting and expressing conversation content in the language of the other party. Qualifications include possession of an overseas master's degree, possession of an overseas bachelor's degree with at least one year of experience in interpreting and translating, or fluency in a foreign language other than the mother tongue or Korean. However, foreign students who have graduated from domestic universities may be exempt from interpreting and translating related experiences and majors.
To obtain an E-7 visa for specific activities as an interpreter/translator, one must have expertise in the field related to interpretation and translation. In addition, one must have the ability to speak a foreign language other than the mother tongue and possess certified qualifications for language proficiency (TOPIK level 5 or higher, or Social Integration Program Level 5 or higher). Domestic companies that hire foreign interpreters/translators must employ at least five Korean nationals as regular employees to protect domestic employment. Required documents for inviting companies include a foreign employment plan (utilization plan), a standard labor contract, a list of domestic employment insurance subscribers, a copy of the business registration certificate, and a proof of tax payment.

■ Overseas Sales Representative
An overseas sales representative is someone who conducts sales activities for foreign countries, managing all aspects of trade, including both offline and online sales. This person is necessary for companies that are currently exporting or importing goods or have plans to do so in the future. An overseas sales representative is someone who performs sales activities to sell products to foreign buyers and also to import products from overseas sellers. In the case of selling products online, this person selects products to sell on an online shopping mall through the internet, manages inventory, responds to customer inquiries, and manages all tasks related to shipping ordered products. Therefore, domestic online shopping mall salespersons, people who only handle packaging for shipping, and trade clerks are excluded. Companies that want to hire an overseas online product sales representative must belong to the trade sector and have exported goods worth over 5 billion won in the previous year. They must also have an office space for the sales representative. The eligibility requirements for an overseas sales representative include applying the general criteria for the specific activity (E-7) visa and submitting an employment recommendation letter issued by the Korea Trade-Investment Promotion Agency (KOTRA). The employment standards are applied based on the screening criteria for protecting national employment, but special exceptions are made for foreign investment companies and exporters in special language regions like Russia.

■ Duty-free Shop Sales Representative
This refers to someone who drafts sales plans and directly engages in sales for foreigners at domestic duty-free shops to increase exports and sales. The allowed job positions are duty-free shop sales representatives and sales representatives at duty-free shops for foreign tourists, and the screening criteria for protecting national employment are applied. Eligibility requirements include having at least three years of experience as a travel guide or duty-free shop sales representative, graduating from a domestic university or higher, or graduating from a four-year college or higher overseas, regardless of major or experience.

■ Special Agency Administrative Officer
This refers to someone who handles general administrative and functional tasks at foreign embassies in Korea, including administrative and functional officers at foreign embassies, administrative and functional officers at foreign cultural centers in Korea, administrative and functional officers at the Korea International Trade Association, and administrative officers at international organizations. If someone is hired as a special agency administrative officer, they can apply for the specific activity (E-7) visa with only a cooperative letter from the foreign embassy in Korea. However, please note that domestic helpers for embassy personnel are eligible for the visitor (F-1) visa.

■ Kitchen Manager and Cooks
This refers to the kitchen manager, who plans cooking and supervises and coordinates the work of cooks and kitchen assistants in hotels, restaurants, and ships, as well as cooks who prepare and cook various ingredients to make food directly in restaurants and other facilities. Foreigners who have completed specialized cooking courses in culinary fields at outstanding private institutions, professional colleges, or higher education institutions and have obtained domestic certified chef qualifications can also obtain a specific activity (E-7) visa.
Please note that the minimum requirements for hiring one foreign cook in a general restaurant, excluding Chinese restaurants, are as follows: 1) employing at least two domestic workers (including nationals listed in the employment insurance roster for more than three months, ethnic Koreans, and permanent residents through marriage immigration), 2) having a facility area of 60 square meters or more (companies designated as tourism convenience facilities can be recognized if the facility area requirement is at least 50% of the minimum standard), and 3) paying an annual value-added tax of at least KRW 3 million (annual sales of at least KRW 60 million). However, even if the minimum requirements are met on paper, invitations are generally restricted if there is no utilization or attraction for foreign tourists or if there are suspicions of using low-wage foreign cooks. The required documents include a visa issuance approval application, a passport copy, a photo, an invitation reason and utilization plan, a business registration and business license copy, an employment contract copy, an identity verification document, proof of business performance (value-added tax taxable standard certification), an original and copy of the chef qualification certificate (apostille verification from the home country's government or verification by the Korean consulate in the host country), a certificate of employment or career (apostille verification from the home country's government or verification by the Korean consulate in the host country), and a resume.

■ Medical Coordinator
A medical coordinator refers to a person who provides comprehensive services for foreign patients visiting hospitals, including guidance and support for medical treatment, patient recruitment activities, medical appointment scheduling, interpretation, and customer service. The qualifications for this position include being a licensed healthcare professional, such as a doctor, nurse, or pharmacist, holding a bachelor's degree or higher in a related field from a Korean university and completing a coordinator training program under the Korean Health and Welfare Human Resources Development Act, or possessing the "International Medical Tourism Coordinator" qualification as specified in the National Technical Qualification Act (Annex 2). Required documents include a copy of the "International Medical Tourism Coordinator" national technical qualification certificate (for those who have it), a copy of the coordinator training program completion certificate (for those who have it), a copy of the foreign patient recruitment organization registration certificate, a recommendation letter from the Minister of Health and Welfare (Health Industry Policy Department), and a personal identification document.
For employment eligibility, the company must be either a medical institution registered as a foreign patient recruitment organization under Article 27-2(1) of the Medical Service Act or a foreign patient recruitment operator registered under Article 27-2(2) of the same act. The allowed number of personnel per company is limited to two for medical institutions and one for recruitment operators. However, if the number of foreign patients recruited in the past year exceeds 1,000, additional hiring is allowed for every additional 1,000 patients.

■ Legal Expert
A legal expert refers to a foreign legal specialist who provides advice and translation services related to foreign law and performs legal functions other than litigation, prosecution, and litigation procedures. Possible professions include lawyers or barristers licensed under foreign law and foreign legal consultants under the Foreign Legal Consultants Act. The qualifications for this position require holding a relevant foreign legal qualification, obtaining approval as a foreign legal consultant under the Foreign Legal Consultants Act, and registering with the Korean Bar Association. Required documents include the relevant foreign legal qualification, the foreign legal consultant registration certificate issued by the Korean Bar Association (for foreign legal consultants), and a recommendation letter issued by the Commissioner of the Korean Intellectual Property Office (for barristers). The general standards for the E-7 visa category, including certification issuance and stay management guidelines, apply as qualification requirements.
