Scope of Activities Company management, trade, and for-profit business activities

Eligible Persons Trade operators who have been assigned a unique trade business identification number by the Korea International Trade Association (KITA) in accordance with the Foreign Trade Act and the Foreign Trade Management Regulations.

Persons dispatched or invited to companies importing industrial equipment (machinery) to provide technical services necessary for the installation, operation, and maintenance (repair) of such equipment.

Persons dispatched for the supervision of shipbuilding and industrial equipment manufacturing (dispatched by the client or a professional service provider designated by the client).
Maximum Duration of Stay That Can Be Granted at One Time 2 years
Activities Outside the Scope of Stay 1. Expansion of Exemptions from Permission for Activities Outside the Scope of Stay
If a foreign national wishes to receive education at a regular educational institution (elementary, middle, high school, or university) without undermining the original purpose of stay, no separate permission process is required as long as it is within the permitted period of stay. (Effective from June 15, 2009)

2. University Lecture Activities by Foreign-Invested Company CEOs and Other Highly Skilled Professionals

* Scope of Activity :
Activities involving lectures at universities for up to 90 days, permitted as a short-term employment (C-4-5) activity outside the originally granted status.

* Eligible Persons :
① Holders of D-7, D-8, or D-9 visas who work as full-time executives (director level or higher) at domestic companies (including foreign-invested companies)
② Holders of professional visa statuses: E-1, E-3 to E-5, or E-7

* Required Documents :
① Application form (Form No. 34), passport, alien registration card, and fee
② Recommendation letter from the university president (or dean)
③ Copy of business registration certificate (or unique number certificate)
④ Original and copy of employment contract
⑤ Consent letter from the current employer
Change or Addition of Workplace ➠ Not subject to permission (notification) for change/addition of workplace : This is handled as a notification of change in foreigner registration information.

※ For holders of the following visa types not intended for profit, changes are processed through a notification of change in foreigner registration information (according to Enforcement Rule Article 49-2) :

A. Holders of Culture and Arts (D-1), Student (D-2), General Trainee (D-4) to Trade Management (D-9) visas : Change of affiliated organization or institution (including name change)
B. Holders of Job-Seeking (D-10) visa : Notification of training commencement or change of training institution (including name change)
C. Holders of Visiting Employment (H-2) visa :

* When first employed by an individual, organization, group, or business: report the start of employment
* If already employed: report any change of individual, organization, group, or business (including name changes)

※ For holders of Assignment (D-7) to Trade Management (D-9) visas transferring within the same corporate group, the following documents must be submitted and processed as a notification of change in foreigner registration information :

A. Persons dispatched or invited to companies importing industrial equipment (machinery) to provide technical support for installation, operation, or maintenance
B. Persons dispatched for supervision of shipbuilding or industrial equipment manufacturing (including those sent by the client company or a designated service provider)

Required Documents :
① Application form (Form No. 34), passport, one standard-size photo, fee
② Statement of reason for change of stay status
③ Dispatch order or certificate of employment (issued by headquarters)
④ Shipbuilding contract or equipment import contract
⑤ Copy of business registration certificate
⑥ Certificate of tax payment (if the foreign national has no tax history, submit the company’s certificate)

3. Change of Stay Status for Foreign Individual Business Owners (Effective from October 29, 2012)

Eligible Individuals :

* New business owners who :

* Have introduced foreign capital of at least KRW 300 million in accordance with the Foreign Exchange Transactions Act and Regulations, and
* Have registered a business under the Value-Added Tax Act and intend to operate a company or engage in for-profit business in Korea
* Or, have invested at least KRW 300 million under the Foreign Investment Promotion Act and obtained a Foreign-Invested Company Registration Certificate

≪Ineligible Stay Statuses for Change≫

* Technical Training (D-3), Non-professional Employment (E-9), Seafarer Employment (E-10), Others (G-1), Pure/Group Tourism (C-3-2), Medical Tourism (C-3-3), Working Holiday (H-1), and Visit-Employment (H-2)
* Note : For Working Holiday (H-1), change of status is not allowed for nationals of countries that prohibit it under bilateral agreements (e.g., France, Ireland, the UK)

Additional Allowances :

* D-2 (Student) and D-10 (Job-Seeking) visa holders who have obtained or are expected to obtain a master’s degree or higher from a Korean university, and have invested at least KRW 100 million

* Up to KRW 50 million of the investment may come from domestic sources; the rest must be foreign funds under the Foreign Exchange Transactions Act
* Bachelor’s degree holders (or expected graduates) from Korean universities who have earned 30+ points through the OASIS entrepreneurship support program (OASIS-1 to OASIS-8)
* Individual business owners previously holding a D-8 (Corporate Investment) visa

* Even if the previous investment was under KRW 300 million, they are still eligible unless they lost D-8 status due to reasons like overstaying abroad. In such cases, the KRW 300 million capital requirement must be met as if they were new applicants.

* For D-9-5 student entrepreneurs : domestically sourced funds may be combined using personal balance statements or usage documents
⑦ Certificate of completion of OASIS program (if applicable)
⑧ Business performance documents (e.g., export/import licenses, VAT return forms)
* Only required if business activities occurred under a C-3-4 or other short-term visa prior to status change
⑨ Proof of residence (e.g., lease agreement, rental payment receipts)
⑩ Proof of business premises (e.g., lease agreement, photos of office, signboard)
* Short-term leases (under 6 months), residential-only leases, or online-only businesses are generally not recognized unless business nature requires it (e.g., warehouse lease contracts)

4. Change to Long-Term Stay Status for German Nationals Entering with Visa Exemption (B-1)

Eligible Stay Statuses :
All long-term stay statuses except Technical Training (D-3), Non-professional Employment (E-9), and Working Holiday (H-1)

Permissible Period :
The maximum period that can be granted for each stay status

5. Change of Stay Status for Chilean Nationals Holding Short-Term Visit (C-3-4) Visa to Assignment (D-7), Corporate Investment (D-8), or Trade Management (D-9)

Eligibility :
Businesspersons intending to engage in the following activities as managers, executives, or individuals with essential expertise:

* Those substantially engaged in the trade of goods or services between their home country and Korea
* Those who, or whose companies, have invested or are in the process of investing a significant amount of capital in Korea and are providing advice or essential technical services related to the establishment, development, management, or operation of that investment

Extension of Stay Period 1. Extension of Stay for Trade Visa (D-9-1) Holders Under the Points-Based System

A. Eligibility Criteria :

* Applicants must score at least 5 points in mandatory items out of the total 50 points in the Trade Visa Points System, and meet the extension criteria outlined in the points table (see Attachment 1 : "Criteria for Stay Extension").
* Special Cases :

* If a trade education institution recommends the foreigner after its internal review, the **mandatory 5-point item requirement is considered met**, allowing for stay extension.
* Those who complete an advanced course (30+ hours) at a trade education institution receive an additional 3 points in elective items.

B. Required Documents :
① Application form (Form No. 34), passport, Alien Registration Card, fee
② Copy of business registration certificate, proof of business premises (e.g., lease contract)
③ Proof of residence (e.g., lease agreement, rent payment receipts)
④ Documents supporting the applicant’s points

Proof of Trade Performance (choose one) :

1. Export/import performance certificate issued by the Korea International Trade Association (KITA) or Korea Trade Statistics Promotion Institute
2. Export performance certificate issued by a foreign exchange bank
3. Online mall transaction records (up to 40% of unreported trade performance may be recognized)

Additional Notes :

* For employment of Korean nationals, submit employment insurance documents proving full-time employment of 6 months or more
* For tax payment, submit a Certificate of Tax Payment issued by the National Tax Service

2. For Those Engaged in Supervision of Shipbuilding/Equipment Manufacturing or Installation/Operation/Maintenance of Export Equipment (Machinery)

* Withholding receipt for Earned Income (issued by a tax cooperative)
* Income certificate (issued by the tax office)
⑥ Proof of residence (e.g., lease agreement, accommodation confirmation letter, stay period expiry notice, utility bills, dormitory fee receipts)

3. Foreign Individual Business Owners and Trade Business Operators Who Were Former International Students

Required Documents :
① Application form (Form No. 34), passport, Alien Registration Card, fee
② Copy of business registration certificate, business license (if applicable), foreign-invested company registration certificate (if applicable)
③ Documents proving normal business operations, such as :

* Income certificate, tax payment certificate, or certificate of tax history
* (Validity: must be issued within 30 days)
* If tax record is insufficient, additional documentation may be requested
④ Proof of residence (e.g., lease contract, accommodation confirmation, notice of stay expiry, utility bills, dormitory fees, etc.)
⑤ Proof of business premises (e.g., lease agreement, photos of office and signage)
⑥ Proof of employment of Korean nationals (e.g., withholding tax statements, employment insurance, showing continuous employment of 6 months or more – only required if applicable)

Additional Requirement: Personal Tax Certificate for Those With Trade Management (D-9) and Similar Visas

Even if the foreign national is paid by an overseas headquarters while working at a Korean business site, unless otherwise specified in a tax treaty, they are subject to Earned Income Tax (Type B) in Korea.

A. If the person joined a Type B Taxpayer Association and completed year-end tax settlement via monthly withholding :
➠ Submit the Withholding Receipt for Type B Earned Income issued by the tax cooperative head.

B. If the person did not join a Taxpayer Association and filed & paid Composite Income Tax independently :
➠ Submit the Income Certificate issued by the local tax office.

> ⚠️ For Type B earned income, if the payer is not in Korea, the worker must fulfill the tax obligation themselves. If not a member of a taxpayer association, they must file composite income tax in May of the following year. If a member, the association withholds tax monthly and pays it to the tax office by the 10th of the next month.

Re-entry Permit 1. Implementation of Re-entry Permit Exemption System (Effective from December 1, 2010, Revised Enforcement Rule)

* Foreign nationals are exempt from requiring a re-entry permit if they plan to re-enter Korea within 1 year from the date of departure.
* If the remaining period of stay is less than 1 year, re-entry is permitted within the remaining stay period without the need for a re-entry permit.

> ※ However, individuals subject to entry restrictions or visa issuance restrictions must visit the local immigration office (or branch office) with jurisdiction over their residence to obtain a re-entry permit.

2. Multiple Re-entry Permit

(Note : Nationals of Saudi Arabia, Iran, and Libya are restricted from multiple re-entry, except those holding the following statuses: F-6 (Marriage Migrant), D-2 (Student), or D-4 (General Trainee).)

* For those who wish to re-enter after more than 1 year but within 2 years from departure, within the valid period of stay
