Chapter 6 Employment Adjustment

An Employer shall conduct employee education to prevent sexual harassment at the work place once or more times a year. ※ Punishable with a fine not to exceed three million WON

(1)Prohibition of Sexual Harassment at Work and Education to Prevent Sexual Harassment at Work (Article12, Article 13)
(2)Employers, senior workers, or workers shall not engage in sexual harassment at work.
(3)Contents be included in the sexual harassment prevention education
1) Laws and regulations regarding sexual harassment at work;
2) Procedure for dealing with sexual harassment at work of the workplace concerned and criteria of measures thereof;
3) Grievance counseling and remedy procedures for victims of sexual harassment at work of the workplace concerned; and
4) Other matters necessary for the prevention of sexual harassment at work
(4)The prevention education under paragraph (a) may be conducted through employee training, morning sessions, meetings, etc. depending on the size and circumstances of the business: Providing the sexual harassment prevention education by means of mere dissemination, posting, etc. of educational material shall not be recognized as prevention education.

Article 12 (Prohibition of Sexual Harassment on Job)
No employer, superior, or worker shall commit any sexual harassment on the job against another worker.

Article 13 (Preventive Education of Sexual Harassment on Job)
(1) The employer shall conduct preventive education of sexual harassment on the job (hereinafter referred to as "preventive education of sexual harassment") in order to prevent sexual harassment on the job and to create the given conditions whereunder his/her workers may work in a safe working environment.
(2) An employer and a worker shall receive a preventive education of sexual harassment pursuant to paragraph (1).
(3) Matters necessary for the detail, methods, frequency, etc. of preventive education of sexual harassment pursuant to paragraphs (1) and (2) shall be prescribed by Presidential Decree.
