Chapter 1 Employment Relations

Is it possible to request an employee to perform occasional ad hoc tasks or missions outside the city or country of employment? Under which conditions?

Article 657(2) (Exclusivity of Rights and Duties), Civil Act, as last amended by Act No. 12881, Dec 30, 2014

An employer has a right of personnel deployment. As long as the order is justifiable, it is possible for an employee to go to a business trip abroad. However, when an employer wants to send an expatriate worker for a long time, then there needs to be managerial necessity and consent from the applicable employee.

The employer should be the same even if an employee performs tasks outside the country.
