Chapter 3 Working hours, Recess, Off-Days and Leave

Does local law provide rules on how to apply a shift / roster system for drivers?

Article 59 (Special Cases of Work and Recess Hours), Labor Standards Act, as last amended by Act No. 12325, Jan. 21, 2014

There are no specific rules on how to apply a shift/roster system for drivers.
However, workers who are in transportation business can be applied exception of 12 hours of overtime limitation or recess regulation with written agreement with a labor representative.

Article 59 (Special Cases of Work and Recess Hours)

An employer who runs any of the following businesses may, if he/she has entered into any written agreement with the labor representative, have workers work in excess of 12 hours per week as referred to in Article 53 (1) or change recess hours as referred to in Article 54:

1. Transportation business, goods sales and storage business, finance and insurance business;

2. Film production and entertainment business, communications business, educational study and research business, advertisement business;

3. Medical and sanitary business, hotel and restaurant business, incineration and cleaning business, barber and beauty parlor business;

4. Other businesses determined by Presidential Decree, which are necessary for the convenience of the public at large or in consideration of the characteristics of business.
