Handling Overtime for White-Collar Employee

➜ Prior approval and compensation with O/T allowance
Article 16. Overtime Work
1. The Company's policy is for employees to avoid working overtime whenever possible. If deemed necessary because of business circumstances, the Company may order employees to work in excess of the specified working hours, and employees shall not refuse without justifiable reasons. Working overtime at the request of the Company shall be compensated pursuant to the Labor Standards Act ("LSA"). The provisions of Article 63 of the LSA concerning overtime shall not apply to employees engaged in supervisory or managerial work, or employees handling confidential matters.
2. Working overtime or on holidays shall occur after obtaining prior approval from the Division Manager or any other authorized manager and has to be reported to Human Resources.
3. Those who work overtime will be compensated based on the ordinary wage.

Type #2
➜ Prior approval and provision of replacement off-day, fixed O/T for the first two hours
Article 12 (Overtime, Night, and Holiday Work)
The Company can order its employees to work overtime or on holidays when necessary.
1. In principle, overtime, night, and holiday work is acknowledged only when employees are asked to perform such work by their supervisor or with prior approval from their supervisor.
2. The Company may, instead of paying additional wages, grant leave to a worker to compensate for extended, night, and holiday work by written agreement with the employee.
Article 22 (Composition of Salary and Decision of Annual Salary)
1. Salary is composed of the base pay, fixed O/T, and meal allowances.
Article 23 (Additional Allowances)
1. The Company shall, in addition to ordinary wages, pay fifty percent or more thereof for overtime, night work, or holiday work. However, for managerial employees, the first two hours of overtime shall be calculated into fixed O/T allowance.

➜ Prior approval and compensation by replacement off-day
Article 12 (Overtime, Night, and Holiday Work)
The Company can order its employees to work overtime or on holidays when necessary.
1. In principle, overtime, night, and holiday work is acknowledged only when employees are asked to perform such work by their supervisor or with prior approval from their supervisor.
2. In principle, overtime pay or additional allowances shall only be permitted when employees receive prior approval, and overtime (or holiday or night work) shall be compensated in the form of a replacement off-day on a working day. Replacement off-days shall be used with the department head's approval within a one-month period. The company may also replace holiday or night work allowances in this way.
